1. Acceptance of Terms

Welcome to BuzzzIrl ("BuzzzIrl," "we," "our," or "us"). By downloading, installing, creating an account, or using the BuzzzIrl mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and BuzzzIrl. Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

BuzzzIrl is a social location-based chat application that connects users with nearby conversations and community members. The App provides:

• Location-based discovery of nearby conversations and users
• Real-time messaging and chat features
• User profiles and social networking tools
• Notifications about nearby activity and new messages
• Community features for local events and gatherings

3. Eligibility

You must meet the following requirements to use BuzzzIrl:

• Be at least 13 years of age (or the minimum age required in your country)
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the App under applicable laws
• Provide accurate registration information

If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf.

4. Account Registration and Security

To use BuzzzIrl, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Not share your account with others
• Notify us immediately of any unauthorized use of your account
• Not create multiple accounts or impersonate others

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage from unauthorized account access.

5. User Conduct

You agree NOT to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Harass, bully, stalk, intimidate, or threaten any person
• Impersonate any person or entity
• Share false, misleading, or fraudulent information
• Post spam, advertisements, or unsolicited promotional content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Share content that is sexually explicit or pornographic
• Promote violence, hate speech, or discrimination
• Share private information of others without consent
• Use automated tools (bots, scrapers) to access the App
• Attempt to hack, disrupt, or gain unauthorized access to our systems

Violation of these conduct rules may result in content removal, account suspension, or permanent ban.

6. User-Generated Content

BuzzzIrl allows you to post messages, images, and other content ("User Content"). By posting User Content, you:

• Retain ownership of your content
• Grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the App
• Represent that you have the rights to post the content and grant us this license
• Acknowledge that your content may be visible to other users based on your privacy settings

You are solely responsible for your User Content. We do not endorse or guarantee the accuracy of User Content.

7. Content Moderation

We reserve the right to monitor, review, and remove User Content that violates these Terms or our Community Guidelines. However, we are not obligated to monitor all content and do not assume liability for user-posted content.

Users can report inappropriate content or behavior using in-app reporting tools. We will investigate reports and take appropriate action.

8. Location Services

BuzzzIrl uses location data to provide core features (finding nearby conversations). By using the App, you consent to:

• Sharing your approximate location with other users to enable proximity-based features
• Our collection and processing of location data as described in our Privacy Policy

You can control location permissions in your device settings, but disabling location may limit app functionality.

9. Privacy

Your use of BuzzzIrl is subject to our Privacy Policy, which explains how we collect, use, and protect your information. Please review it at buzzzirl-privacy-policy.html.

10. Intellectual Property

The App and all its contents, features, and functionality — including design, logos, text, graphics, software, and other materials — are owned by BuzzzIrl and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or exploit any part of the App without our express written permission.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability and fitness for a particular purpose
• That the App will be uninterrupted, secure, or error-free
• That User Content is accurate, reliable, or appropriate
• That conversations, users, or locations are verified or safe

You use BuzzzIrl at your own risk. We are not responsible for the behavior of other users or the content they post.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BUZZZIRL, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, messages, or account information
• Harm resulting from interactions with other users
• Emotional distress or privacy violations by other users
• Consequences of relying on User Content
• Issues arising from location-based features

Some jurisdictions do not allow the exclusion of certain warranties or liabilities, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless BuzzzIrl and its affiliates from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another person or entity

14. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if you:

• Violate these Terms or our Community Guidelines
• Engage in conduct that harms other users or the community
• Provide false information or impersonate others

You may also delete your account at any time in the app settings. Upon termination, your right to use the App immediately ceases. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will survive.

15. Changes to the App

We may update, modify, or discontinue the App or any features at any time without notice. We are not liable for any modifications, suspensions, or discontinuation of the App.

16. Dispute Resolution

These Terms shall be governed by the laws of the United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You agree to waive your right to a jury trial or to participate in a class action.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BuzzzIrl regarding use of the App.

19. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or via email. Continued use of BuzzzIrl after changes constitutes acceptance of the revised Terms.

BY USING BUZZZIRL, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE, DO NOT USE THE APP.
