1. Acceptance of Terms

Welcome to StepFine ("StepFine," "we," "our," or "us"). By downloading, installing, or using the StepFine mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and StepFine. Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

StepFine is a step-tracking accountability application that helps users achieve their daily step goals. The App provides:

  • Integration with Apple Health (HealthKit) to read step count data
  • Daily step goal setting and tracking
  • An accountability mechanism that locks the app when goals are missed
  • Unlock challenges and time-based unlock periods
  • Customizable reminder modes (Gentle, Normal, Aggressive)
  • Streak tracking and historical statistics
  • Optional in-app purchases for premium features

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device(s) solely for your personal, non-commercial use.

You may NOT:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Copy, distribute, or create derivative works from the App
  • Remove or alter any proprietary notices or labels on the App
  • Use the App for any commercial purpose without our express written permission
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Use the App in any way that violates applicable laws or regulations
  • Circumvent the lock mechanism through hacking or exploitation

4. User Accounts

StepFine does not require user accounts, registration, or login credentials. All app functionality is available immediately upon installation without providing any personal information.

5. Health Data and HealthKit

StepFine accesses step count data from Apple Health (HealthKit). By using the App, you:

  • Grant StepFine permission to read step count data from HealthKit
  • Acknowledge that step counts may vary based on device accuracy and HealthKit data
  • Understand that StepFine is not responsible for inaccuracies in step counting by your device or HealthKit
  • Can revoke HealthKit permissions at any time through iOS Settings

Important: StepFine reads step data from HealthKit but does not write to HealthKit. All HealthKit data remains on your device and is governed by Apple's privacy policies.

6. Not Medical Advice

StepFine is a motivational and informational tool designed to help you stay accountable to your fitness goals. It is NOT a medical device and does not provide medical advice, diagnosis, or treatment.

  • Consult a healthcare professional before starting any fitness program
  • Do not rely on StepFine for medical decisions
  • If you experience pain, dizziness, or discomfort while walking, stop and seek medical attention
  • Step goals should be set responsibly based on your fitness level and health status

You are solely responsible for setting appropriate goals and ensuring your walking routine is safe and suitable for your health condition.

7. Lock Mechanism and Unlock Periods

StepFine's core feature is an accountability lock that activates when you miss your daily step goal. By using the App, you understand and agree that:

  • The app will lock access to certain features if you fail to meet your daily step goal
  • You can unlock the app by completing an unlock challenge or waiting for the unlock period to expire
  • The default unlock period may be up to 30 days, depending on your settings and performance
  • The "I need more time" feature provides temporary extensions but does not eliminate accountability
  • You can disable the lock feature at any time through app settings, but this may reduce effectiveness
  • The lock mechanism is designed as a motivational tool, not a punishment

We are not responsible for any frustration, inconvenience, or consequences resulting from the lock mechanism. It is your choice to use StepFine and set your own goals.

8. In-App Purchases and Payments

StepFine may offer optional in-app purchases for premium features. All purchases are processed through the Apple App Store.

  • All payments are handled by Apple according to their terms and policies
  • Prices are set in the App Store and may vary by region
  • Purchases are generally non-refundable except as required by law or Apple's refund policy
  • For refund requests, contact Apple Support directly
  • We reserve the right to modify pricing or discontinue features at any time

9. User Conduct

You agree to use StepFine only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Attempt to circumvent the lock mechanism through exploits or hacks
  • Use the App in a manner that could harm yourself or others
  • Modify or interfere with the App's functionality
  • Use automated tools to manipulate step counts (e.g., shaking devices artificially)
  • Share or distribute hacks, cheats, or exploits for bypassing accountability features

10. Intellectual Property Rights

The App and all its contents, features, and functionality are owned by StepFine, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The StepFine name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of StepFine or its licensors. You may not use such marks without our prior written permission.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, STEPFINE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability and fitness for a particular purpose
  • That the App will be uninterrupted, timely, secure, or error-free
  • That step counts will be 100% accurate (accuracy depends on device and HealthKit)
  • That the App will help you achieve specific fitness results
  • That using the App is appropriate for your health condition

You use the App at your own risk. We make no guarantees about fitness outcomes or health improvements.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STEPFINE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, including streak data or statistics
  • Physical injury resulting from walking or exercise
  • Frustration or emotional distress from the lock mechanism
  • Reliance on inaccurate step counts
  • Loss of productivity or time due to app locks
  • Any health consequences from using or not using the App

This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless StepFine and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the App
  • Your violation of these Terms
  • Any injury or health issues resulting from your use of the App
  • Your violation of any applicable laws or regulations
  • Your circumvention or attempted circumvention of the lock mechanism

14. App Updates and Modifications

We may update, modify, or discontinue the App (or any part thereof) at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

Updates may change features, including the lock mechanism, unlock periods, or other core functionality. Continued use of the App after updates constitutes acceptance of changes.

15. Third-Party Services

StepFine integrates with Apple Health (HealthKit), a third-party service provided by Apple. Your use of HealthKit is governed by Apple's terms and privacy policies. We are not responsible for HealthKit's performance, accuracy, or data handling.

16. Platform Requirements

StepFine is available for iOS devices. You are responsible for:

  • Owning a compatible iOS device with HealthKit support
  • Maintaining an updated operating system
  • Granting necessary permissions (HealthKit access, notifications)
  • Ensuring your device accurately tracks steps

We do not guarantee the App will work on all devices or iOS versions. Older devices may have reduced functionality.

17. Termination

We reserve the right to terminate or suspend access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your use of the App at any time by deleting it from your device. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, and limitations of liability.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

19. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to new terms taking effect through an App Store update or notification within the App.

By continuing to use the App after revisions become effective, you agree to be bound by the revised terms.

20. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StepFine regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.

23. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING STEPFINE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

You also acknowledge that the lock mechanism is an accountability feature designed to motivate you, and that you are using it voluntarily as a tool for self-improvement.
